The appeals raise in an acute form a number of points of general importance as to the validity of bye-laws, and one point of particular importance, as to the ability of defendants who are charged with offences created by subordinate legislation to challenge the validity of that legislation in the course of criminal proceedings.
In the Forest Moor appeal, the second appeal, the court was only asked for its opinion in relation to two related issues.
In the case of the Forest Moor bye-law the description differs in so far as there is no reference to the boundary of the lands as being "marked by and includes the outer perimeter fence and gates".

HMS Forest Moor, situated at Nidderdale near Harrogate on the edge of the North Yorkshire National Park, has decommissioned after 43 years service.
Although more than 200 miles from the nearest front-line RN unit, Forest Moor had consistently delivered a high-quality communications service to the Royal Navy.
The Harrogate Sea Cadets were on parade – they enjoyed a close association with Forest Moor – and Flag Officer Scotland, Northern England and Northern Ireland, Rear Admiral Nick Harris, presided over the occasion, speaking of the pride of those who served at the establishment.

I was transferred for a short time to HMS Indomitable where I completed the training and returned to the Vengeance.

From Mercury I went on loan draft to HMS Lynx for a short period before joining HMS Torquay and there I stayed until 1978 when I joined HMS Blake to go on deployment to the states.

But inside, there were shouts of dismay as councillors voted five to three to back the plans as they decided there were no legitimate planning grounds for refusing the application.
