The decision raises the possibility that an employer may have to litigate discrimination actions twice – in an arbitration hearing with the employee and in federal court with the EEOC – and possibly be faced with inconsistent results.
To ensure fair RIF policies, employers should establish specific procedures for selecting which employees to terminate, ensure that the criteria used to select employees for layoff are defensible, and document the reasons for selecting particular employees.
