This confusion is relieved by understanding that the perpendicular impact speed of the helmet is usually not the same as the road speed of the motor cycle and that the severity of the impact is determined not only by the speed of the head but also by the nature of the surface it hits.
Such helmets have an open cutout in a band across the eyes and nose, with a plastic face shield (which may be clear or tinted) that generally swivels up and down to allow access to the face.
Such helmets are often smaller and lighter than DOT-approved helmets, and are unsuitable for crash protection because they lack the energy-absorbing foam that protects the brain by allowing it to come to a gradual stop during an impact.

Ummm...when California enacted their motorcycle helmet law this is the most populous state in the country with more motorcycles than almost any other jurisdiction in the world, deaths went down 32% in 1992.
Texas repealed their (second?) helmet law, the second most populous state in the country, 20 million people, year round motorcycling, an awful lot of motorcycles in the state of Texas, they repealed it, deaths went up 32% the next year.
I've always considered the helmet law to kind of be the poster child for Government overstepping it's bounds as far as protecting us from ourselves.

Although the Tennessee Legislature may believe that they can authorize the "commissioner of safety" to approve or disapprove helmets, the commissioner of safety is confined, by law, to adopting only those standards established by the National Highway Traffic Safety Administration.
If the commissioner of safety has adopted FMVSS 218, which the law insists that he ultimately must, the Tennessee helmet law is thereby rendered unconstitutionally vague and can be challenged on that basis, and removed.

If called on to do so, the manufacturer would be required to submit 8 helmets for testing, and even then it would not take into account such things as age, whether or not a helmet has been dropped, and a myriad of other circumstances that would keep a helmet from performing up to the standard.
The helmet with the highest scores ever reported on a FMVSS-218 test, was about 3 foot across and weighed about 60 pounds, but it absolutely maxed out every single element of the test standard with flying colors (except labeling).
I can show you a California case where a three judge appellate panel upheld a helmet ticket conviction by a fourth, based on the fact that the letters on the DOT sticker on the biker's helmet were 1/16th of an inch too short.

By federal law, anything that does not pass all of the Department of Transportation's helmet safety standards cannot be sold as a motorcycle helmet.
The Department of Transportation must APPROVE the helmet for sale as a motorcycle helmet to the general public (pardon my redundancy, but it seems to be the only way to make a point to you people).

When Pennsylvania modified their helmet law, a study was mandated to report on its effects.
The new law calls for the inclusion of 45 minutes of motorcycle-awareness instruction as part of the classroom portion of the driver's education curriculum.
At issue is the placement of the law in the Vehicle Code, under "equipment." The Judicial Council, under pressure from the CHP, had ruled that the requirement had not been intended to be correctable, but this flies in the face of the actual written law.

Well, it seems that this may be the loophole in the helmet laws for New York riders, and riders in other states where helmet laws are imposed.
It shall be unlawful for any person to operate or ride upon a motorcycle unless he wears a protective helmet of a type which meets the requirements set forth in section 571.218 of the federal motor vehicle safety standards as may from time to time be amended.

i wear a helmet cos its safer, not cos the law says i have to.
Many ppl still use a helmet after the helmet has suffered damage in an accident, the law does not require them to buy a new helmet it just requires us to wear one.
Also whats the latest stats on how long a helmet lasts it used to be 3 years, maybe now with new materials and such it may be 4 or 5 years, but how many helmets out there are older than this.
