Helvetia was purportedly engaged in the business of treating individuals suffering from cancer with a purported "new" and "unique" cancer treatment involving "intracellular hyperthermia" therapy.
Helvetia's materials also described intracellular hyperthermia therapy to investors as a cancer treatment involving a "proprietary "agent, '" which when administered to cancer patients, internally heats their malignant tumor cells "to the point they can no longer survive" while, at the same time, sparing normal tissue and having no toxic effects.
Individuals who chose to invest with Helvetia were passive investors, did not retain the ability to control the profitability of their investment, and expected their investments to generate returns exclusively through the efforts of the defendants.
