Henry James Sumner Maine - Wikipedia, the free encyclopedia
Sir Henry James Sumner Maine (August 15, 1822 - February 3, 1888) was a English comparative jurist and historian, son of Dr James Maine, of Kelso, Roxburghshire.
Maine cannot have known much Roman law in 1847, but in 1856 he contributed to the Cambridge Essays the essay on Roman law and legal education, republished in the later editions of Village Communities, which was the first characteristic evidence of his genius.
Maine's temperament was averse from the labour of minute criticism, and his avoidance of it was no less a matter of prudence.

SIR HENRY JAMES SUMNER MAINE - LoveToKnow Article on SIR HENRY JAMES SUMNER MAINE
The practical side of Maines experience was not long lost to India; he became a member of the secretary of states council in 1871, and remained so for the rest of his life.
Meanwhile Maine had published in 1885 his one work of speculative politics, a volume of essays on Popular Government, designed to show that democracy is not in itself more stable than any other form of government, and that there is no necessary connection between democracy and progress.
Maines temperament was averse from the labor of minute criticism, and his avoidance of it was no less a matter of prudence.

Freedom of contract - Wikipedia, the free encyclopedia
The freedom of contract demonstrates membership of a free civil society in which citizens have autonomy.
Henry James Sumner Maine (1822-1888), proposed that social structures evolve from roles derived from status to those based on contractual freedom.
A status system establishes obligations and relationships by birth, whereas a contract presumes that the individuals are free and equal.

 Social Evolutionism
Its leading opponent was Franz Boas, whose main disagreement with the evolutionists involved their assumption that universal laws governed all human culture.
Maine also contrasted with other evolutionists in that he was not a proponent of unilinear evolution (Seymour-Smith 1986:175-176).
“…The main stimulus for [the comparative method] came out of biology where zoological and botanical knowledge of extant organisms was routinely applied to the interpretation of the structure and function of extinct fossil forms.

The department belongs entirely to the basin of the Loire, the bed of which is wide but shallow, and full of islands, the depth of the water in summer being at some places little more than 2 ft. Floods are sudden and destructive.
The chief affluent of the Loire within the department is the Maine, formed a little above Angers by the junction of the Mayenne and the Sarthe, the latter having previously received the waters of the Loire.
Other tributaries of the Loire are the Thouet (with its tributary the Dive), the Layon, the Evre, and the Divatte on the left, and the Authion on the right.

Encyclopedia article on Henry James Sumner Maine [EncycloZine]   (Site not responding. Last check: 2007-11-06)
Lectures delivered by Maine in this capacity were the groundwork of Ancient Law (1861), the book by which his reputation was made at one stroke.
Not having been separately published, it is perhaps the least known of Maine's writings; but its combination of just perception and large grasp with command of detail is not easily matched outside W Stubbs's prefaces to some of the chronicles in the Rolls series, and (more lately) FW Maitland's monographs.
In all these works the phenomena of societies in an archaic stage, whether still capable of observation or surviving in a fragmentary manner among more modern surroundings or preserved in contemporary records, are brought into line, often with singular felicity, to establish and illustrate the normal process of development in legal and political ideas.

Trade Secrets and Collective Bargaining: A Solution to Resolving Tensions in the Economics of Innovation
The main reform proposed will be to amend state trade secret statutes to allow workers to switch jobs without restriction, unless a collective bargaining agreement has been negotiated to assure fair compensation for the workers' contribution to any trade secret innovations.
Yet, since the time English jurist Henry Maine declared, "The movement of the progressive societies has hitherto been a movement from Status to Contract," n11 the assumption of modern thought had been that analyzing employment in terms of property was essentially a throwback to a medieval frame of thought.
The main reform suggested by the analysis of this article is for unions and other advocates to argue for legislation requiring that any trade secret be declared invalid unless fair compensation has been negotiated collectively with employees involved in developing them.

They do not believe it to be of the nature of immemorial usage, 'of which the memory of man runneth not to the contrary.' They look upon its rules as a main part of the conditions on which a state is originally received into the family of civilised nations.
The main drawback to the use of such metaphors in legal discussion is that men, and particularly lawyers, begin in time to conceive the metaphor as having an existence of its own, and they make it the starting point for new inferences which themselves are often metaphorical.

English Literature - Sir Henry Sumner Maine
Still another great writer in the historical field was Sir Henry Sumner Maine (1822-1888), whose special department was the development of law and the organization of society.
Maine early under-took to correct the theory of organized society maintained by Blackstone.
He showed in his "Ancient Law" (1861) that social institutions were developed by custom, and that society moves from status to contract, that is, from regarding everything as fixed by class usage to allowing special arrangements to be made by individuals.
