Other disputes about his title to land and avowsons, payment of rent and exercise of office under the Earl of Worcester involved him in further litigation and brought him regularly to the notice of the Council in the marches and of Cromwell.

Historians suppose this "late earl" to be Henry Percy, 8th earl of Northumberland, who in June 1585 was found dead in the Tower, where he had been imprisoned upon suspicion of complicity in a Catholic plot, the Throckmorton conspiracy.
The creation of Earl of Northumberland on 1 May 1557 was "with remainder, failing heirs male of his body, to his brother, Henry Percy." The 7th Earl was executed on 22 August 1572 and immediately the brother, Henry Percy, was recognised as the next Earl.
Anne Somerset, countess of Northumberland, was the granddaughter of Lucy Neville, daughter of John Neville (who also happened to be earl of Northumberland for a while) and the Somerset family descends from John of Gaunt.

Notes: The Herbert family of Troy, near Monmouth, was established by Sir William Herbert, a bastard son of William Herbert, Earl of Pembroke of the first creation.
This Sir William Herbert was an annuitant of Edward Stafford, 3rd Duke of Buckingham, and a frequent visitor with his wife and sons of Thornbury Castle, Gloucestershire, where Charles Herbert first appears in 1508.
