Most of these elements have been enshirined over the last decade by legislation of the European Council, the European Commission and the European Parliament, as well as by the jurisprudence of the European Court of Justice and the European Court of Human Rights.
Originally they shared the Court of Justice and Parliament in common, having separate Councils and Commissions (called the High Authority in the case of the ECSC); but the Merger Treaty of July 1967 merged their Councils and Commissions into a single Council and Commission.
On the side of the European Union it was partly motivated by a desire to reunite Europe after the end of the Cold War, and an effort to tie Eastern Europe firmly to the West in order to prevent it falling again into communism or dictatorship.

 A New System for Electing the European Parliament
In the European Parliament, each member state has a number of seats, and it is basically up to that state how its members should be elected (but to the best of my knowledge, currently all states use some kind of proportional representation).
Here, the Greens/EFA won 41 constituency seats, but according to their shares of the votes, they should only have received 40 seats altogether (the main culprit seems to be the low turnout in the UK).
How the constituency seats are distributed within each country is not important in this context (but it is quite possible that a state might want not to take area and history into account, e.g., the UK might want to place more seats in Scotland than the population figures would suggest.

In order for democratic elections to be fair and competitive, opposition parties and candidates must enjoy the rights to freedom of speech, assembly, and movement as necessary to voice their criticisms of the government openly and to bring alternative policies and candidates to the voters.
The Democracy Watch (International) website, further defines fair democratic elections as, "Elections in which great care is taken to prevent any explicit or hidden structural bias towards any one candidate, aside from those beneficial biases that naturally result from an electorate that is equally well informed about the various assets and liabilities of each candidate".
An example of this kind of structural bias was the 2004 re-election of Russian president Vladimir Putin, in which the state controlled media consistently supported his election run, consistently condemned his opponents, provided virtually unlimited free advertising to Putin's campaign, while barring attempts by his opponents to run campaign advertisements.
