Hoffmann-La Roche - Wikipedia, the free encyclopedia
In 1999, Roche pleaded guilty in the United States and paid a $500 million fine, then the largest fine ever secured in the U.S. The European Commission fined Roche 462 million euros for the same infraction in 2001, also a record fine at the time.
Roche Holding AG is listed in on the SWX Swiss Exchange, ticker ROC.S. Its revenues during fiscal year 2002 were $9400 million, ranking 13th amongst the pharmaceutical companies of the world.
Roche was fined accordingly, but unfortunately a bungle on the part of the EEC allowed the company to discover that it was Adams who had blown the whistle.

 HOFFMANN-LA ROCHE v. Promega
Roche responds to the district court’s analysis of this issue by arguing that the inventors and Dr. Kunkel simply differed over how to interpret the results of the experiments involving the prior art and claimed enzymes, and that a dispute of that sort cannot give rise to a finding of inequitable conduct.
Roche’s claim that another experiment measured a specific activity of approximately 390,000 units/mg also fails for similar reasons, because there is no proof that that experiment was performed under conditions equivalent to Example VI with a per milligram specific activity value approaching 250,000 “units,” as that term is defined in Example VI.
Roche next suggests that the use of the past tense in Example VI is not really a misrepresentation since all of the steps in that procedure were purportedly part of two procedures that Roche did perform, Prep 3 and Prep 4.

Roche and Syntex contend that Johnson, who made the initial contact and primarily conducted the negotiations, was acting in his capacity as a Vice-President of Roche and not as Roche’s counsel.
Roche and Syntex then filed suit, in the United States District Court for the District of New Jersey, against Torpharm and other generic drug manufacturers that had filed applications.
