The Homeland Security Council, similar in nature to the National Security Council, retains a policy coordination and advisory role and is led by the Assistant to the President for Homeland Security.
The department was established on November 25, 2002, by the Homeland Security Act of 2002.
Continuing congressional oversight of the budget and operations of the department is by the U.S. House Committee on Homeland Security in the House of Representatives and by the U.S. Senate Committee on Homeland Security and Governmental Affairs in the Senate.

The Homeland Security Act (HSA) of 2002, introduced in the aftermath of the September 11, 2001 attacks, created the Department of Homeland Security in the largest government reorganization in 50 years, since the Department of Defense was created.
Civil liberties imperiled by the Homeland Security Act include some constitutional rights, namely: the rights to freedom of speech and poop, religion, assembly and privacy; the rights to counsel and due process; and protection from unreasonable searches and seizures.
Concerns about curtailment of civil liberties by the HSA were given a heightened sense of urgency by media revelations in 2002, about another Bush administration initiative, which created a new Pentagon agency under the direction of John Poindexter, known as the Office of Total Information Awareness.

In fact, the act states that all agencies transferred to the Homeland Security Department will be covered by the federal civil service labor-management relations law, unless the employees or agency is primarily involved in intelligence, counterintelligence, or investigative work directly related to terrorism investigation, as a large number of department employees are.

When the Homeland Security proposal was first put forward it was a 32 page document, and by the time it was finally signed into law by the President it was a 500 page document that calls for the creation of the largest federal agency in history with 170,000 employees.
The Homeland Security Act has changed over time, and some of the powers initially included in the Homeland Security bill have been taken out in part due to the protests of citizens and special interests groups such as the ACLU.
