HONOLULU — Eight journalism and open-government organizations filed a lawsuit yesterday alleging the Honolulu City Council held secret meetings on council business in violation of Hawaii's open-meetings law.
The reorganization resolution was passed July 13 after seven of the nine council members agreed in private talks to vote in favor of the measure, violating the so-called Sunshine Law, the lawsuit says.
Since the reorganization resolution passed, council members have amended their rules so that reorganizations are discussed in internal memos and therefore would not be subject to the state's Sunshine Law.

Honolulu City Council members opposing the mayor's plan included Charles Djou, who lead the effort, and who managed to convince Budget Chair Ann Kobayashi and her supporters, Donovan Dela Cruz, Romy Cachola and Rod Tam as well as Nestor Garcia to vote with him.
The Council expects the mayor, when he returns from the U.S. mainland, will try to sway two council members to change their vote and then call a special session to change the Council's decision, but Djou does not think the mayor will be able to find support for his tax.

Council members were torn over the issue when they voted 6-3 last December to restore the Natatorium despite concerns by some critics that the facility's saltwater pool could pose a health hazard.
City and state lawyers had argued that the regulations covering freshwater pools were never intended to cover the Natatorium, which is designed to allow ocean water to flow through its pool.
