Trust law - Wikipedia, the free encyclopedia
In order to qualify as a charitable trust, the trust must have as its object certain purposes such as alleviating poverty, providing education, carrying out some religious purpose, etc. The permissible objects are generally set out in legislation, but objects not explicitly set out may also be an object of a charitable trust, by analogy.
A resulting trust is the form of implied trust which occurs where a trust fails, wholly or in part, as a result of which the settlor becomes entitled to the assets.
The trust has proved to be such a flexible concept that it has proved capable of working as an investment vehicle: the unit trust.

Honorary trust - Wikipedia, the free encyclopedia
An honorary trust, under the law of trusts, is a device by which a person establishes a trust for which there is neither a charitable purpose, nor a private beneficiary to enforce the trust.
While such a trust would normally be void for lack of a beneficiary, many jurisdictions have carved out two specific exceptions to this rule: trusts for the care of that person's pets; and trusts to provide for the maintenance of cemetery plots.
The name of the device derives from the lack of any beneficiary legally capable of enforcing an honorary trust: the trustee is bound by honor, but not by law, to carry out the wishes of the creator of the trust.

A trust created by means of a promise enforceable by the trustee to transfer property to the trustee is valid notwithstanding that the trustee may resign or die prior to the transfer.
A trustee is entitled to be repaid out of the trust property, with interest as appropriate, for: (1) expenditures that were properly incurred in the administration of the trust; and (2) to the extent that they benefitted the trust, expenditures that were not properly incurred in the administration of the trust.
The duty to administer the trust with prudence is a fundamental duty of the trustee, which is not affected by whether the trustee receives compensation but which may be altered by the terms of the trust.

The Law of Trusts for the Care of Pets
That is, most trust agreements contain a so-called “perpetuities savings clause” providing that, regardless of what the rest of the trust agreement says, all beneficial interests in the trust must terminate or be distributable no later than some designated period in compliance with the applicable rule against perpetuities.
The original 1990 version of UPC §2-907 simply placed the pet trust within the common law perpetuities period and provided that a pet trust terminates upon the earlier of: (a) the death of the last animal covered by the pet trust; or (b) 21 years after the establishment of the pet trust.
Note that although the New York statute is entitled “Honorary trusts for pets”, it provides that the pet trust may be enforced by an individual designated in the trust instrument or appointed by the court upon petition.

Although the court recognized the trust as unenforceable and subject to the exercise of a power of the trustee, it held that the trust was not unlawful, and therefore could be performed.
The original UPC extended a trust's coverage to a pet's offspring, perhaps recognizing that many who would take advantage of a pet trust are concerned not only for their pet but for all its progeny, born or unborn, who are dependent upon the guardian.
A garden-variety trust for a family member not only contributes little or nothing to public welfare, but can last much longer than that of a pet trust, because the lives of animals are generally less than those of humans.

Providing for Pets in the Estate Plan
Although a trust for the benefit of a pet is considered by statute to be valid in Missouri, a pet trust is unenforceable because the pet can neither sue the trustee for breach of his fiduciary duties nor otherwise compel the trustee to carry out the terms of the trust.
However, an honorary trust for the benefit of a pet can achieve the goals of the owner to direct his or her desire for the care treatment of their pets and to set aside funds for those purposes.
For example, drafting the trust to provide for the pet for life (not to exceed 21 years, of course) and the remainder to the trustee upon the pet’s death may provide an incentive for the pet to meet with an untimely death.

A Charitable Remainder Trust is a trust in which during the life of the trust an amount is paid not less than annually to the grantor or to another non-charitable beneficiary.
Upon the termination of the trust (usually after a term of years or an individuals life), the remainder of the assets in the trust are given to the charitable beneficiary.
This type of trust is considered a grantor trust resulting in the income generated being taxed to the settlor and the assets in the trust at the settlors death being included in the settlors taxable estate.

According to the DoH: ‘Although there is no such thing as an NHS wide honorary contract, the intention is that where a researcher works across many NHS organisations they should not have to obtain multiple contracts … they would obtain an honorary contract from the main NHS organisation they work with.
If you have a contract from an NHS Trust other than BLT you should check with the Directorate your research will be based in to see whether they will accept the terms and conditions attached to your contract.

Subject to a caveat discussed below, an animal cannot be a beneficiary of a traditional trust for a number of reasons, not the least of which is the simple fact that it cannot bring its own case to enforce the trust before a court.
