Hooters Inc., 1996 WL 164427 (N.D.Ill. March 29, 1996), a federal court certified a class action brought by three males who claimed they were denied employment at two ''Hooters'' restaurants in Orland Park and Downers Grove, Ill., because of their sex, in violation of Title VII.
Despite the franchisor's objections that the class should be limited to applicants to the two franchises' restaurants to which plaintiffs had applied, the court certified a nationwide class of all male applicants at all restaurants owned directly by the franchisor as well as all the independent franchisees.
