I have located an article on "smarter" hotlink protection, being a method which is supposed to prevent any bandwidth charges (other than the incoming server call, I suppose).
Hotlinking can be "theft of services", but even that is a tough case to make.
Hotlink protection blocks the hotlink attempt, and then the hotlink is quickly found out, due to the odd behaviour displayed in the log files.

If they are hotlinking a product logo to use on their site ie cpanel, that's bandwidth theft...
As for the copyright infringement: that mainly depends on what is being hotlinked, if you actually own the content then it would be copyright infringement but if it's just some random image which doesn't specifically belong to you, then it's no copyright infringement.
I agree that it's relatively easy to stop hotlinking, but since it's technically impossible to stop outright theft of images, you would just encourage people to copy them onto their own servers.

When you sign up for webhosting, you are given a set amount of space to store your files, you are also given a set amount of bandwidth which is the amount of data you may transfer.
So, when someone hotlinks your image, they are using your bandwidth, which is essentially stealing from you.
I am sure a lot of this is plain old laziness and people not knowing better, but it still irritates me. And in a lot of cases, if people just asked to use an image of mine, I would say yes, but doing it without permission is just low, and is the same as theft.
