People packed into Judge Charles Jones’ courtroom Monday had to strain to hear the elderly jurist, but, while his voice was soft, his words were clear: If you want to claim an election was illegal, your chances of satisfaction are a lot better if you lodge a complaint before the election is held.
Jones ruled against attorney John Howard, whose lawsuit claimed City Councilmember Donna Frye’s mayoral candidacy was illegal because San Diego’s charter includes language suggesting the city doesn’t allow write-in candidates in the general election, which puts the charter in conflict with another document, the Municipal Code, which explicitly does allow write-ins.
