Public Citizen | Litigation Group | Litigation Group - John Hancock Life Insurance Litigation Reply Memorandum in ...
Defendant John Hancock's response to Senator Metzenbaum's motion to compel discovery or, in the alternative, for limited intervention raises a grab-bag of procedural points--most of which are irrelevant--in an effort to maintain the secrecy of its side-deal with the Rose Objectors.
Metzenbaum then filed his motion to compel discovery or, in the alternative, to intervene, on July 8, 1998--one week after the expiration of the thirty-day period for response to his discovery requests (but without a response from defendants or class counsel).
Metzenbaum's July 8, 1998 motion for limited intervention raised none of the issues that were implicated by his earlier protective motion to intervene for the simple reason that the July 8 motion is based exclusively on post-judgment events that were not raised, and logically could not have been raised, by the earlier motion.

Metzenbaum vs Glenn   (Site not responding. Last check: 2007-11-07)
Metzenbaum's comment was widely publicized and interpreted by many — including Glenn himself — as a slam that Glenn had "never held a (real) job (even though Metzenbaum hadn't actually used those words), and Glenn went into the Cleveland debate a few days later well-prepared to answer the charges.
Although Metzenbaum didn't raise the "job" issue during the debate, Glenn nonetheless seized the opportunity to launch into his carefully-crafted "I have held a job" retort, invoking stirring images of motherhood, sacrifice, and patriotism.
Although it was a rehearsed speech rather than the impromptu response legend has since made it out to be, Glenn's stinging rebuke to Metzenbaum was a masterful stroke that swung momentum in his favor.

Metzenbaum then lost in the general election to Robert Taft, but this year the Democratic nomination is more valuable.
The charge rested on the facts that Metzenbaum (whose net worth is $3.6 million) legitimately paid no federal taxes in 1969 because of high interest payments and losses in various investments and is involved in a tax-court dispute over a 1967-68 deduction of $118,000 for plant depreciation.
