Hugh McCalmont Cairns was born in Ireland in 1819.
Cairns' draft memo asserted that section 47 was wrong in suggesting that there was a distinction to be drawn between an appeal to the sovereign in council as a form of prerogative remedy in special cases and the usual type of appeal to the Judicial Committee.
Cairns was careful to emphasize the facts of the case which involved a ruling, inter alia, that a candidate for election was guilty of corrupt practices and that the court below was exercising a power formerly exercised by the legislature.
