Hyperion Records is an independent British classical record label, named after Hyperion, one of the Titans of Greek mythology.
Hyperion became renowned for recording lesser-known works, particularly reviving romantic piano concertos which have fallen from the repertory, works by Scottish romantic composers and English music of the Renaissance to the Baroque.
Hyperion maintained that the editions were not original compositions, and therefore were not subject to copyright and further that Dr. Sawkins did receive payment in the form of a hire fee from the performers for their rental.

The issue in the appeal is that Hyperion published a CD which used a sheet music edition of a public domain work, but that the mere effort of making a clean modern edition of the public domain work was enough for the sheet music to be considered a new work, and worthy of copyright.
This effectively means that the only way to record or perform a public domain work is to go to a facsimile (photograph) the public domain work, and to make your own edition.

 La Folia -- Schubert Lieder on CD
The recording, made in mono sound in October of 1952, was originally released on an LP that lasted a mere forty-two and a half minutes.
Another CD from 1977, recorded in stereo, presents Fischer-Dieskau this time with the great Sviatoslav Richter as accompanist in another live Salzburg Festival recital of twenty-three Schubert songs, this one on Orfeo C 334 931 B. Both of these are representations of Schubert singing at its finest.
These recordings were made from 1972 to 1984, and their sound as remastered for CD is beautifully open and natural.

Lionel Sawkins, a scholar of French Baroque music, recently took the Hyperion record label to court with the claim that his editions of the works of Michel-Richard de Lalande entitled him to royalities from Hyperion's recordings of same.
The label is one of the best small companies in the business, long celebrated for its early-music recordings.
He makes a good point: Hyperion knew going into this recording that Sawkins was expecting to receive royalties, and so they can't claim to have been blindsided by his lawsuit.

Naxos, the impulse-buy classical label which sells discs at five pounds, dollars or euros the world over has been reissuing early recordings that had been long deleted by the music biz, which functions on a flow of hyped-up novelty.
In May last year, a small and rather beautiful record label, Hyperion, was sued by an academic, Dr Lionel Sawkins, who demanded royalties for recordings of music by Michel-Richard de Lalande.
Hyperion is now awaiting a Court of Appeal decision, originally due this week but now postponed for a month.

The majors have a stranglehold on distribution, packing stores with hybrid trash, while the independent classical sector is in worse doldrums than usual with elite Hyperion facing a million-pound bill for a copyright case it unwisely contested to an unnecessary and probably inexorable conclusion; Hyperion will survive, but with deep cuts.
It is an independent label, run by Craker and Moseley from their dining-room tables, but it will also have major-label distribution and access to proper budgets.

 LARGE SCALE ORCHESTRA/OPERA
This record has a "big sound", which is very wide (though with average depth), well focused and has superb separation of instruments, to the degree that you could almost write out the score from it.
I chose this recording for two reasons; first it is one of their best sonically, and the music is much more accessible and popular than probably ant of the others.
Hyperion reminds me of Harmonia Mundi in many ways, including its varied repertoire, with the main difference being their focus on English composers and performers, which makes sense because it is an English label.
