 ICAC at the Ukrainian CCI. About Court.
International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC at the UCCI) is an independent permanent arbitration institution (third-party tribunal) which activities are regulated by the Law of Ukraine On International Commercial Arbitration of 24 February, 1994 and the Rules of the International Commercial Arbitration Court at the UCCI.
ICAC at the UCCI takes into consideration disputes according to its jurisdiction only in case of the presence of written agreement of the parties to refer to it all or certain disputes arising in connection with any concrete relationships nevertheless of their contractual or non-contractual character.
Awards of the ICAC at the UCCI are final and obligatory for the parties and in a case of their refuse to execute them voluntarily are enforced according to the New-York Convention on recognition and enforcement of foreign arbitral awards (1958) in the place of the location of a debtor.

A plea that the ICAC is exceeding the scope of its jurisdiction shall be raised as soon as the matter alleged to be beyond the scope of its jurisdiction is raised during the arbitral proceedings.
The employees of the ICAC Secretariat shall be appointed by the President of the Ukrainian Chamber of Commerce and Industry on the proposal of the ICAC President.
The ICAC Secretariat shall maintain correspondence with the parties and shall mail the case documents to either of the parties at the addresses indicated by the party for the documents to be mailed to it or to the other party.

The Museum is pleased that ICAC has recognised the efforts taken regarding security.
As ICAC says in its report: " There is no evidence to suggest that prior to 1998 when the bulk of the thefts took place, the Australian Museum had less effective security measures in place than other museums." (p 33)
However, the Museum maintains that ICAC's criticism that the matter should have been reported to them earlier is unfair.

 International Cotton Advisory Committee (ICAC)
ICAC is an international, intergovernmental organization of countries with an interest in the commodity cotton.
The aims of ICAC are: to monitor developments affecting the world cotton situation; disseminate statistics on world cotton production, trade, consumption, stocks and prices; advise member states of measures considered suitable and practicable for the furtherance of international collaboration, with due regard to maintaining and developing a sound world cotton economy.
A decision against this was taken since the USA did not withdraw from ICAC and it was felt that South Africa is too far removed from the cotton markets.

A person arrested by the ICAC may be taken to a police station and dealt with under the Police Force Ordinance, or may be taken to an ICAC office.
If an arrested person is taken to an ICAC office, he may be detained there if an officer of the rank of a Senior Commission Against Corruption Officer or higher considers it necessary for the purpose of further inquiries.
Upon conclusion of the interview, the ICAC officers must provide the interviewee with a copy of the taped interview or the written statement (as the case may be).

*ICAC failed to investigate the allegation that the young man arrested in a toilet with former NSW Supreme Court Judge Yeldham was in fact the subject of an appeal a few years later in a very serious criminal matter in which Yeldham sat as a Judge of Appeal.
ICAC has not dealt with the question as to whether the RCBI and its officers failed to deal with this matter properly because of improper influence by an NSW Govt Minister the subject of allegations to the RCBI and in the Media.

According to ICAC, Mr Wade "knowingly abused his position as a public official for private gain" while the two real estate agents, Ken Williams and John Ashe, colluded with Mr Wade to defraud the Home Purchase Assistance Authority or Housing Department.
ICAC said Mr Wade accepted two holidays at Queensland resorts from Mr Williams, benefits it found were "corrupt inducements or rewards".
In total, ICAC found that Mr Wade engaged in corrupt conduct in 12 separate matters between 2000 and 2004.
