International Criminal Court - Wikipedia, the free encyclopedia
The ICC is designed to complement existing national judicial systems, however, the Court can exercise its jurisdiction if national courts are unwilling or unable to investigate or prosecute such crimes, thus being a "court of last resort," leaving the primary responsibility to exercise jurisdiction over alleged criminals to individual states.
They also argue that the states which object to the ICC are those which regularly carry out genocide, war crimes and crimes against humanity in order to protect or promote their political or economic interests.

The ICC warns them early on in the recruitment process that Satan will use people around them to attack their conversion into the ICC by telling them that the ICC is a cult.
Often ICC members can be very open to talking about their involvement and examining the other side of the story, but beware - if the ICC leaders find out they will try to stop any intervention.
The most important thing to remember is that we want the ICC member to have a time when they can examine their involvement and be presented with the other side of the story - the side the ICC would rather not have them hear.

United States Efforts to Undermine the International Criminal Court (Human Rights Watch Paper, )
Article 98(2), which provides that the ICC may not proceed with a request for surrender that would require the requested state to act inconsistently with its obligations under international agreements, was included in the Rome Statute to provide an orderly and rational process for the handling of suspects among states cooperating with the Court.
In the instances covered by an impunity agreement, the ICC would be unable to prosecute individuals over which it should have jurisdiction.
Given that the U.S. has now officially repudiated the ICC, Washington has eliminated the underlying rationale for a bilateral agreement with the United States, since the Bush Administration would refuse to surrender an American suspect to the ICC even if the Court found the U.S. investigation or prosecution to have been a complete sham.

US Opposition to the International Criminal Court - Global Policy Forum - International Justice
US Congressman Dennis Kucinich argues for ratification of the International Criminal Court (ICC) in the broader context of “international unity,” a concept the Bush administration shuns by refusing to sign global treaties on the ICC as well as on climate change and weapons bans.
This move seemed “an extraordinary turn around” for the administration that actively opposed the Court for the past four years, and observers speculate that it was the “latest sign of moderation” from US President George Bush at the start of his second term.
Luis Moreno Ocampo, the ICC's new chief prosecutor, believes that the lack of interaction between the US and ICC is a “mistake.” By opposing the court the US rules out a potential aid in its “War Against Terrorism” and therefore slows down further progress.
