  ICJ Australia - Report - ICJ Australia opposes new counter terrorism laws - Position Paper 7 Oct 2005
ICJ Australia takes the position that rather than being a measured response to the threat of terrorism, the proposed further laws hand victory to terrorists by undermining and irrevocably altering the very society they are designed to protect.
ICJ Australia therefore calls on the Australian government to abandon these legislative proposals that breach fundamental rights, and demonstrate its commitment to the rule of law by conforming to the procedures established by Article 4, and with the Covenant generally.
ICJ Australia says that it is difficult to contemplate interrogation and other investigative techniques that would require a period of fourteen days to complete, unless they involve undue psychological intimidation and coercion arising from conditions of incarceration and intense interrogations of 14 days’ duration.

The ICJ is the successor to the Permanent Court of International Law, which existed prior to the formation of the United Nations at the close of the Second World War.
In this capacity, the ICJ hears cases brought by one state against another and renders a binding decision as to the legal issues of the case.
Because the ICJ ruled to hear the jurisdictional issue before the facts of the case, both sides never presented their full sides and fact-findings and contentions in a public forum, certainly not in the ICJ.

The ICJ is one of the six principal organs of the United Nations.
The ICJ's function is twofold: to settle in accordance with international law the legal disputes submitted to it by States, and to give advisory opinions on legal questions submitted by duly authorized international organs and agencies.
Finally, the jurisdiction of the ICJ can derive from the reciprocal effect of optional declarations, whereby each disputing State has accepted the jurisdiction of the Court as compulsory in the event of a dispute with another State having made a similar declaration.

 The Review - Courting Trouble
The ICJ decision placed much emphasis on the right of the Palestinians to self-determination, and decided that Israel was required to accord rights under international treaties to the Palestinians, even while their claim to statehood remained nascent.
However, the ICJ also decided that Israel could not rely on the doctrine of self-defence to justify the security barrier because the threats of force that the security barrier was designed to counteract were not "imputable to a foreign State".
The ICJ was asked by the General Assembly to assume that Israel was building a wall on Palestinian land and then asked to say whether - based on that assumption - the wall was illegal.

The ICJ denounced the route of the security fence, found that construction of the fence on the route was not the only means to safeguard Israelis and that the fence infringes a number of rights of Palestinians.
While the ICJ states quite vaguely that Israel should and is even obligated to protect its citizens from fatal hostile acts, it nonetheless rejects the fence's very construction, because it contravened international law.
The ICJ also called on the U.N. General Assembly and Security Council to consider what further action is required to bring an end to the existence of the barrier, which it deemed illegal.

The ICJ called on the Government of Sri Lanka to ensure witnesses are properly protected against threats to their lives and well-being.
The ICJ said that this inquest should be the first stage in the process of establishing the cause of death of these 17 Sri Lankan aid workers, identifying who was responsible for their execution-style killings and commencing prosecutions against those responsible.

 ASIL Insights: ICJ Rules "The Wall" Violates International Law
The ICJ was satisfied that the Tenth Emergency Special Session that had adopted the request for an advisory opinion was duly reconvened and could properly address the matter before the Court, under General Assembly resolution 377 A (V) (the Uniting for Peace resolution).
Regarding the scope of application of the applicable treaties, the ICJ concluded that the ICCPR and the Convention on the Rights of the Child are applicable both to territories over which a state has sovereignty and to those over which that state exercises jurisdiction outside sovereign territory.
The ICJ found that the construction of the wall has led to the destruction or requisition of Palestinian properties under conditions that contravene the requirements of Articles 46 and 52 of the 1907 Hague Regulations and Article 53 of the Fourth Geneva Convention.

The ICJ should not be confused with the International Criminal Court or a court exercising jurisdiction under Belgium's War Crimes Law, both of which also potentially have "global" jurisdiction.
The number of decisions made by the ICJ has been relatively small, but there has clearly been an increased willingness to use the Court since the 1980s, especially among developing countries, although the USA withdrew from compulsory jurisdiction in 1986, meaning it accepts the court's jurisdiction on only a case-to-case basis.
Article 2 of the Statute provides that all judges should be "elected regardless of their nationality among persons of high moral character", who are either qualified for the highest judicial office in their home states or known as lawyers with sufficient competence in international law.

The ICJ, consisting of 15 judges, is the principal judicial organ of the United Nations and is seated in The Hague, the Netherlands.
The ICJ has discretion to indicate provisional measures of protection (comparable to an injunction under domestic law), aimed at preserving the respective rights of either party pending the Court's final decision, only if it appears that it has prima facie jurisdiction over a case.

 Israel Attorneys Issue Reply To ICJ Fence Opinion
On February 23, 2005, Osnat Mandel, head of the High Court Section of the State Attorney’s Office, released a 177-page statement that called the ICJ opinion “incomplete, unspecific, inaccurate and unbalanced.” It also noted that the Hague court’s ruling was an advisory opinion that is not legally binding.
The government maintained that the question the court was asked to review was biased because it referred to the fence as a “wall,” even though only 5 percent of the barrier that had been built to that point was a concrete wall.
Mandel rejected the ICJ analysis and application of the 1907 Hague Convention and the 1949 Geneva Convention.

 Background of the International Court of Justice
Jurisprudence refers to the decisions made by the ICJ in past cases that may relate to a current one.
Article 59 of the ICJ Statute deals with this issue, stating that, “The decision of the Court has no binding force except between the parties and in respect of that particular case.” This means that the decision made about a case between certain states will only affect those states.
This is especially true since the ICJ is currently hearing cases between the Former Republic of Yugoslavia and the 10 NATO countries that were involved in the intervention.
