ITAR is administered by the Office of Defense Trade Controls in the U.S. Department of State, and is defined at 22 CFR Parts 120-130, implementing the Arms Export Control Act, 22 USC 2778.
ITAR references publicly available information as being "public domain." The term "public domain" under ITAR does not mean dedicated to the public, which is the definition under intellectual property law.
In addition, ITAR specifically exempts from the requirement of a license disclosures of unclassified technical data in the U.S by U.S. institutions of higher learning to foreign persons who are their bona fide and full time regular employees.

For example, DARPA programs are all subject to ITAR, which explains why you can't find much information about them on their web site.
By the way, the only two countries that receive any special status are the United Kingdom and Australia, and you can't just send them info either, you have to ask permission but presumably it is a little easier to obtain.

We concluded that the prior draft of the ITAR had a number of unconstitutional applications, specifically with regard to transactions in which an exporter, unconnected with any foreign enterprise, disseminated technical data knowing or having reason to know that the data may be taken abroad and used there in the manufacture or use of arms.
The summary of the current draft notes that the list of exemptions from the licensing requirement of the ITAR was one of the provisions which received the most comments and that concerns were expressed about the relationship between that licensing requirement and the First Amendment.

ITAR started out as a way for Congressional Republicans to hurt the CEO of Loral, who was (is?) one of the largest contributors to the Democratic Party, and to embarrass the Clinton Administration.
If I was a Democrat, and a Republican had introduced a bill for ITAR reform, and other Republicans had attacked that ITAR-reform Republican as doing something that hurt national security, I might use it in my campaign against him or her.
Meanwhile, the most signficant damage from ITAR is encurred in the long-term as other countries incrementally replace and eliminate their dependence on U.S. suppliers.

FYI, apparently, there is no difference between "flight" and "technology" as far as ITAR is concerned.
IA office has had preliminary contact with the state department and it seems that rover technology has never been placed under ITAR restriction.
There is a hope that the state department will give this to the commerce department which will lower the level of restriction.

But she agreed that ITAR approval is based on a political agenda, saying there are some countries we don't cooperate with because of the foreign policy interests of the US.
She cited the biggest prohibition against China stems from Tiananmen and is based on human rights concerns, "it has nothing to do with engineering." She added, this is not to say we don't have other concerns with China.
