Ibarretxe may think that his “Free Association” is a consequence of the freedom to choose, but –in the way it is formulated in the Plan- it is actually an imposition on two States –Spain and France- and on the European Union.
The Ibarretxe Plan foresees a reform of the Spanish Constitution: a bilateral committee -created to this end- and a Special Chamber in the Constitutional Court -consisting of six judges appointed equally by both parties- would settle differences between the State and the CLAE.
The Ibarretxe Plan comes into conflict with the European process of union and the Draft Constitution based, among other things, on the intangible nature of the Union founding States, including their borders and political systems, as well as on the cession of sovereignty from the States to the Union.

Ibarretxe has stressed that the Basque government intends to put the plan to a referendum regardless of the outcome of its talks with the central government.
Presenting the plan Friday, Ibarretxe told the regional parliament in Vitoria that the new statute would be based on the "respect for the right of the Basque people to decide their own future".

I'm not sure if the Catalan plan goes quite as far, although IIRC they are proposing to set up a significantly independent tax gathering system and their own local distinct legal system (I'm unclear on how this is different from the current situation, since presumably still the court of ultimate appeal will be Spanish).
The Ibarretxe Pland was hardly mentioned by the PNV during the autonomous elections this year, although the PNV president, Imaz, started speaking about co-sovereignty this summer.
Zapatero's Socialist government say they plan to open up talks with ETA, the guerrilla independence movement whose efforts to create a Basque nation in the north of Spain and the south of France have resulted in thousands of deaths over the past four decades.
