The Illinois Civil Justice League, together with a coalition of business groups including the Illinois Business Roundtable, the Illinois Manufacturers Association, and the Illinois State Chamber of Commerce, petitioned the Illinois Supreme Court to adopt Rule 225, which would establish new prerequisites for class certification and new procedures for ruling on certification.
Moreover, the petition contends that Illinois is hosting the most controversial form of class actions: "those featuring putative nationwide classes, requiring application of the varying laws of different states, and possessing a tenuous connection to the court in which the lawsuit was filed."
Michael Schostok, president of the Illinois Trial Lawyers Association, expressed hope that the court would permit the rules committee to study the issue and hold a public hearing on the merits of the proposed rule.
