For more than 100 years, courts in the United States have held that the United States Constitution generally requires that a criminal defendant has the right to appear in person at his or her trial as a matter of due process under the Fifth Amendment or Fourteenth Amendment.

In 1993, the Pennsylvania legislature granted a new trial to hippie guru Ira Einhorn, who was convicted while on the lam in France of murdering his girlfriend in 1979.
French officials refused to extradite him, not recognizing convictions in absentia.  But the new trial led to the same result.  In 2002, Einhorn was convicted and sentenced to life in prison.

Introduction by Ed Several weeks before the new Porcupine Tree album In Absentia was released in the US I got my hands on a sampler which (among other stuff) included Blackest Eyes and edited versions of Trains and Strip The Soul, three of the 12 new tracks.
On one hand the sound of In Absentia is a lot rougher than in the previous years, but then again, it isn't miles away from the previous material and as such a logical new direction.
In Absentia follows the direction taken with the previous two albums in a logical line, moving more away from conventional prog, and more into alternative rock with songs that can be categorised at either side of the ever thinning border between the two musical flows.

I had never heard of Porcupine Tree in my entire life until I started seeing people posting about them on the IGN Music Boards.
When I first listened to this album I immediately thought it was one of the best new albums I have wrapped my ears around in a long, long while.
That is to say their music unfolds in an experimental prog rock sort of way, which, as is often the case on the 12 tracks contained within In Absentia, means that they are both haunting and hypnotically intricate.

In Absentia ne s'apprécie pas dès la première écoute, c'est évident.
