Even if one were to construe clauses 7 and 8 according to a rule of mutual exclusion, which I do not, the question to be determined would be, having regard to section 89A(6), is there an incidental relationship between the subject matter of clause 7 the allowable award matter, and notice of termination.
The practical manifestation of that incidental relationship is that an employee whose employment is terminated by the corporation in a redundancy situation will have had a period of notice to adjust to the relevant changed circumstances, resulting from the combined effect of the provisions of clauses 7 and 8.
It follows that my conclusion is that clause 7 is, in effect, an entitlement of notice, incidental to notice of termination, and necessary for the effective operation of the award.
