		The full Ninth Circuit Court of Appeals, in a majority opinion, has affirmed its earlier decision that workers hired as independent contractors by Microsoft who were later reclassified as employees by the IRS for employment tax purposes were also employees for employee benefit plan purposes.
		The full panel of the Ninth Circuit found that there was no dispute that the workers were employees, as evidenced by the IRS' determination that they were employees for employment tax purposes and Microsoft's agreement to that determination.
