Gaming activities may also be conducted on land newly acquired as a result of a land claim settlement, acknowledged as the tribe's initial reservation, or restored to federal recognition.

Gaming revenue in California grew in 2002, increasing 17.2 percent from $2.92 billion in 2001 to $3.43 billion in 2002.
Indian Reorganization Act, passed in 1934, allowed for the formation of tribal governments under federal authority as vehicles for Indian "self-government." The Act gave Indians more power to manage their internal affairs and established a fund for land purchases and educational assistance.
Gaming on U.S. Indian Reservations was officially regulated after Congress passed the Indian Gaming Regulatory Act (IGRA) in 1988.

Gaming tax in the biennium that ends June 30, 2001, comprised 36 percent of the state's general fund budget, and sales and use tax comprised 37 percent after a 12.8 percent surge in gaming tax in the fiscal year that ended June 30, 2000, according to the state budget office.
Gaming tax growth is expected to slow to 5.9 percent in the current fiscal year ending June 30, 2001, followed by growth of 4.7 percent and 4 percent the next two years, the budget office says.
IGRA identified three categories of gaming and said gaming would be conducted in conformance with a tribal-state compact, the tribe's Web site says, adding that IGRA also required the states to negotiate in "good faith" to reach the compacts.

The Indian Gaming Management Staff (IGMS) is responsible for Indian Gaming functions and activities remaining with, or delegated to, the Secretary under the Indian Gaming Regulatory Act of 1988 (IGRA), 25 U.S.C. One of the functions is the review, analysis, and final processing of requests for the acquisition of land into trust for gaming.
The authority to approve or disapprove land acquisitions for gaming is vested with the Assistant Secretary -Indian Affairs (AS-IA); however, the authority to accept title in trust for BIA is vested with the Area Director.
Because the impacts of a gaming facility established on newly acquired land will be difficult to quantify in concrete or tangible terms, the officials consulted should also be invited to address such additional concerns or factors which they believe more fully demonstrate the actual or potential impact of the proposed gaming facility.
