Insurance fraud legislation introduced by the Indiana Chapter of the International Association of Special Investigation Units and the Insurance Institute of Indiana, HB 1403, passed the Senate on Wednesday, 49-0.
The Senate amendment changes the penalty from a Class D felony to a Class A misdemeanor for a person who knowingly and with intent to defraud makes a material misstatement in support of an application for the issuance of an insurance policy.
The Senate concurrence vote on SB 218 failed to pass despite the lobbying efforts on the Senate floor by a coalition including the Insurance Institute of Indiana, Indiana Manufacturers Association, Indiana Chamber of Commerce, Indiana Motor Truckers Association and NAMIC.

INDIANAPOLIS-- A pro-life bill to increase the criminal penalties for the crime of feticide became state law Thursday when the Senate overwhelmingly voted to override pro-abortion Gov. Frank O'Bannon's veto last spring of a 1997 bill to allow individuals who intentionally kill a viable fetus during a crime to be charged with murder.
What shocked Buck at the time was that under Indiana law, the unborn baby's killer could not be charged with murder because an unborn child is not legally considered a person until birth.
While it was not mentioned on the Indiana Senate floor, Thursday marked 25 years since the U.S. Supreme Court's Roe vs. Wade decision that made abortion legal on demand through all nine months of pregnancy.

Sue Landske, R-Cedar Lake, chairwoman of the Senate Legislative Apportionment and Elections Committee, said the fund would not cover the costs of a complete overhaul of the voting systems used in the state.
With a mixed bag of punch cards, optical scanning machines, touch screen systems and lever machines, Indiana does not have a cohesive "election system." But the state does have strict rules about how ballots should be counted and what constitutes a vote, including rules clearly absent in Florida governing the determination of chads.
