As far as I know, inebriation (and/or drug use) always is aggravating, not mitigating circumstance.
The fact that somebody was drunk when they shot the victim means that the defence can claim that inebriation made it impossible for their client to have formed the intent to kill, leading to manslaughter charges etc.
