Inline linking, also known as hotlinking, is the placing of a linked object, often an image, from one site in a page belonging to a second site.
The second site is said to have an inline link to the one where the object is located.

Inline linking or framing the full-sized images to the thumbnails is not a permissible fair use, because the use is not transformative, and the use is not necessary to enhance Arriba Soft's visual search engine.
By inline linking or framing the image, the user accomplishes his purpose without having to advance to the actual site containing the image; therefore, the linking goes beyond the object of the plaintiff's images.
Furthermore, inline linking or framing the entire full-sized image is substantially more than necessary to accomplish the search engine's purpose of directing users to the searched-for images.

Some commentators argue that limits on linking are equivalent to limits on thought and free expression, and this understanding, while not dispositive of the issue, will shape the success of the legal model for control of online copyright.
For text links, you either need to clearly identify the site you are linking to or, then again, if you use the trademark name of the site you may have diluted the copyright so you are better off coming up with your own description of the site.

A website merely linking to someone's web page, even if that page and its URL include a trademark (e.g., "We disagree with MEGACORP, click here to visit their homepage"), is unlikely to be trademark infringement.

Remember that linking in general (a textual link that takes a user from one web site to another) is legal, even if the destination does not like visitors to be directed to them.
Therefore the prohibition of one kind of linking over another not only demonstrates a failure to grasp how the underlying technology works (and could be made to work) but also represents a legal precedent that would require constant maintenance and revision to remain relevant.
First, it could continue down the current line, interpreting certain types of linking as unlawful, and prepare itself to support that decision with endless revisions as more and more (and arbitrary) behaviors are exhibited in web browsers that violate the spirit of the original prohibition.

Sidley Austin Brown & Wood | CyberLaw | Ninth Circuit Addresses Image Hyperlinking
The image itself was imported directly from the original website, but a viewer of the page presented by the click on the thumbnail would not instinctively understand that he or she was seeing a composite webpage formed by content from ditto and an image from a third party.
In that configuration, each thumbnail was matched with a link to more detailed information about the image, plus a source link to the original site for the image.
Circuit decision suggests that merely linking to a website displaying an image is problematic, as doing so changes nothing about the way that the image is displayed to the public.

The plaintiffs did not succeed with their argument that deep links are illegal, because they take users directly to news articles, bypassing introductory pages and advertising, thus depriving the plaintiffs of revenue from their advertisements.
The court stressed the importance of deep links for the internet and held that it is up to the plaintiffs to prevent deep links with technical measures, if they don't like them.

Before Kelly, a few plaintiffs had asserted infringement of their right to create derivative works as a legal theory on which to sue Web sites that inline linked or framed their copyrighted content. This took place despite a plethora of commentators arguing against the theory. The derivative works theory has two permutations.
Since such works necessarily combine the content of two sites, but do not necessarily integrate the content or necessarily “adapt” the content of either site, it is more precise to call them combinative; this asserts only that they combine the two sites’ content.
