  BLESSED INNOCENT V
To Genoa, torn with civil war, the Pope sent a letter pleading for peace, and it was consolation to Innocent that on his deathbed word was brought of his success.
Though a man of peace, Innocent was keenly alive to the plight of Christians face to face with the menace of Islam.
Innocent V died after a short illness on June 22, 1276.

Innocent was but thirty seven years old at this time, and the vigour of youth, guided by master mind, was soon apparent in the policy, of the papacy His first acts were to restore the prestige of the Holy See in Italy, where it had been overshadowed by the power of the emperor Henry VI.
Innocent was one of the best Avignon popes and filled with reforming zeal he revoked the reservations and commendations of his predecessor and prohibited pluralities; urged upon the higher clergy the duty of residence in their sees, and diminished the luxury of the papal court.
Innocent was extolled by contemporaries as a lover of peace and honesty, but he was without energy, guilty of nepotism, and showed no favor to the proposal that he as well as the antipope should resign.

Pope Adrian V - Wikipedia, the free encyclopedia
In December 1251, he was created Cardinal Deacon of San Adriano by his uncle Innocent IV.
He was elected pope to succeed Innocent V on July 12, 1276, but died at Viterbo on August 18, without ever having been ordained to the priesthood; he is buried there in the church of S. Francesco.
Technically, since Adrian was never ordained bishop, he never truly became the Bishop of Rome, but traditionally he is counted in the papal succession.

 Sawyer v. Whitley, 505 U.S. 333 (1992).
The Court of Appeals held thatthe petitioner had failed to show that he was actually innocent of the death penalty because the evidence he argued had been unconstitutionally kept from the jury failed to show that Sawyer was ineligible for the death penalty under Louisiana law.
The phrase "innocent of death" is not a natural usage of those words, but we must strive to construct an analog to the simpler situation represented by the case of a noncapital defendant.
Sensible meaning is given to the term "innocent of the death penalty" by allowing a showing in addition to innocence of the capital crime itself a showing that there was no aggravatingcircumstance or that some other condition of eligibility had not been met.

Elizabeth Gammon BROWN v. STATE of Arkansas
Even more significant, Brown's entire defense was based upon alibi and her contention that she was innocent of selling cocaine to Williams because she was elsewhere at the time of the crime andcould not have been the woman Williams claimed sold her the cocaine.
Here, likewise, because Brown's proof established she was elsewhere and innocent of participating in the cocaine transaction with Williams, it defies common sense to give the jury the possession of cocaine instruction she requested.
The majority states that it "defies common sense" to give the jury instruction on the lesser included offense where defendant's proof established she was elsewhere and innocent of participation in the cocaine transaction, in other words, where an alibi defense was put forth.

No. 02-1824: Dretke v. Haley - Amicus (Merits)
In that circumstance, the defendant is reasonably understood as "actually innocent" of the greater offense even though he remains guilty of a lesser included offense.
Application of the actual innocence exception to defendants who are innocent of an aggravated offense but guilty of a lesser offense is somewhat more difficult to justify than application of the exception to defendants who are entirely innocent.
Nonetheless, the Court decided that the actual innocence inquiry must focus on the "elements that render a defendant eligible for the death penalty" (id. at 347) because the Court was "striv[ing] to construct an analog to the simpler situation represented by the case of a noncapital defendant" innocent of a crime (id. at 341).

In People v Wilson, 78 Mich App 307, 308; 259 NW2d 356 (1977), the Court of Appeals reversed the defendantÂ’s conviction where the record did not establish that the trial court had advised him of his right to be presumed innocent until proved guilty beyond a reasonable doubt.
This line of precedent firmly establishes that, where a trial court has completely failed to advise the defendant of his right to be presumed innocent at the guilty plea hearing, the defendant is entitled to a reversal of his conviction, and either to replead or proceed to trial.

This was, in fact, done at most of the elections during the ninth century, and in 898 the riots which ensued upon the death of Pope Stephen V led John IX to give ecclesiastical sanction to this system of imperial control.
In a council held at Rome in that year he decreed that the election should be made by bishops (cardinal) and clergy, regard being had to the wishes of the people, but that no consecration should take place except in the presence of the imperial legate (Mansi XVIII, 225).

 n Guilty Men
Though the innocent man referred to in the maxim is typically the innocent about to be unjustly punished by the court, this is not always the case.
Better that any number of innocent men, women, and children should be waylaid, robbed, ravished, and murdered by wicked, wilful, and depraved malefactors, than that one innocent person should be convicted and punished for the perpetration of one of this infinite multitude of crimes, by an intelligent and well-meaning though mistaken court and jury!
that is, "that no innocent person should be convicted and that it is better that many guilty go unpunished than one innocent person be convicted." 237 Nonetheless, all innocent readers who have never been convicted may now take a moment to thank Blackstone's maxim for having inspired Western criminal law.
