More often than refugees, the internally displaced tend to remain close to or become trapped in zones of conflict, caught in the cross-fire and at risk of being used as pawns, targets or human shields by the belligerents.
Persons forcibly displaced from their homes who cannot or choose not to cross a border, therefore, are not considered refugees, even if they share many of the same circumstances and challenges as those who do.
As a crucial element of sovereignty, it is the Governments of the states where internally displaced persons are found that have the primary responsibility for their assistance and protection.

IDP (Internally Dispalced Persons) working definition is recent, considering that the issue of Internally Dispalced Persons was linked before to that of Refugees.
By making location the essence of the IDP definition, and not the right to be protected, it did not offer the restoration of one's rights in another location as a durable solution for internally displaced people.
Unlike the term "refugee", which denotes a legal status delineating a particular subset of externally displaced persons, persons forced to leave their homes because of earthquakes or dam projects are, indeed, descriptively "internally displaced persons" whether or not their reasons for flight are similar to those of refugees.

Internally displaced persons do not have a specific international legal instrument that applies to them as do refugees, because any attempt by an outside body to tell a nation how it should treat its own citizens has been seen as a violation of the principle of national sovereignty and self-determination.

Internally displaced persons shall enjoy, in full equality, the same rights and freedoms under international and domestic law as do other persons in their country.  They shall not be discriminated against in the enjoyment of any rights and freedoms on the ground that they are internally displaced.
Certain internally displaced persons, such as children, especially unaccompanied minors, expectant mothers, mothers with young children, female heads of household, persons with disabilities and elderly persons, shall be entitled to protection and assistance required by their condition and to treatment which takes into account their special needs.

These persons fall under the jurisdiction and sovereignty of the state within which they remain, complemented by general international human rights law and international humanitarian law, the latter in cases of an armed conflict, be it an international or internal one.
Very often internal displacement occurs in situations where the government either is unable or unwilling to provide protection and assistance, or, as in the case of Kosovo, government policy and actions in fact create displacement.
However, this author is of the opinion that intervening on behalf of the internally displaced for their protection is an integral part of a humanitarian mandate, and is therefore not to be seen as a political act.

Wars, internal armed conflicts, and state-sponsored persecution of marginalized groups and minorities generate the world’s most destitute populations -- refugees and the internally displaced people (IDP) -- people whose lives are characterized by poverty, insecurity and dim hope of self-sufficiency.
Refugee and IDPs populations generally have no access to schools, employment opportunities, or a source of livelihood; They live unstable and insecure lives, are constantly threatened by the violence around them, and are trapped in the cycle of dependence on diminishing humanitarian aid.
As a response to the particularly difficult situation of the internally displaced and to contribute to their safety, the UNHCR issued its Guiding Principles on the Internally Displaced, which affirmed the human rights of IDPs and called on states and international actors to promote and protect these rights, and extend assistance.

The internally displaced, and particularly large numbers of women and children, are found in camps and public buildings, often in conditions of deprivation and largely dependent upon outside assistance to meet their basic needs.
For example: most of the agricultural workers among the displaced live in urban areas and most of the internally displaced persons originating from mountainous regions did not settle in the north and south-east areas of the country, where the climatic conditions most closely resemble their previous environment.
The law also affirms that the persons to which it applies shall have the same rights, freedoms and duties of all citizens of Azerbaijan and are entitled to apply to the relevant government bodies and to judicial bodies in defence of their rights.

IDPs will also receive direct employment opportunities through the Project, and some 600 households will receive microfinance in the initial round of financing under the Project.
