Intellectual property - Wikipedia, the free encyclopedia
Intellectual property laws vary from jurisdiction to jurisdiction, such that the acquisition, registration or enforcement of IP rights must be pursued or obtained separately in each territory of interest.
Intellectual property laws confer a bundle of exclusive rights in relation to the particular form or manner in which ideas or information are expressed or manifested, and not in relation to the ideas or concepts themselves (see idea-expression divide).
The basic public policy rationale for the protection of intellectual property is that IP laws facilitate and encourage the pursuit and disclosure of innovation into the public domain for the common good, by granting authors and inventors exclusive rights to exploit their works and invention for a limited period.

WIPO was formally created by the Convention Establishing the World Intellectual Property Organization (Signed at Stockholm on July 14, 1967 and as amended on September 28, 1979).
During the 1960s and 70s, developing countries were able to block expansions to intellectual property treaties (such as universal pharmaceutical patents) which might have occurred through WIPO.
In the 1980s, this led to the United States "forum shifting" intellectual property standard-setting out of WIPO and into the General Agreement on Tariffs and Trade (later the WTO), where the North had greater control of the agenda.

In law, particularly in common law jurisdictions, intellectual property or IP refers to a legal entitlement which sometimes attaches to the expressed form of an idea, or to some other intangible subject matter.
The term intellectual property appears to have originated in Europe during the 19th century.
The term intellectual property has been criticized on the grounds that the rights conferred by exclusive rights laws are in some ways more limited than the legal rights associated with property interests in physical goods (chattels) or land (real property).

The German Federal Court (GFC) accepted that the German constitution is not in conflict with the fact that patents for Germany are granted by the EPO (GFC, 3 November 1987, "Kehlrinne", X ZR 27/86).
We strongly oppose to such a position, because even if SMEs use patent attorneys, the latter cannot take full responsibility to give an opinion to their clients without having discussed with them thoroughly all the technical aspects involved in the patented invention.
This means that when the full translation of the patent is not available, the patent attorney should make and provide the client with it, obviously at the client's cost which is clearly unfair since it upsets completely the balance of rights which any law should guarantee.
