Joint Commission, a mechanism used extensively by Britain and the US to settle bilateral disputes mainly of a technical nature.
When joint commissions failed, matters were referred to diplomatic negotiation (eg, ASHBURTON-WEBSTER TREATY, of 1842) or to arbitration by a friendly power (eg, San Juan Islands decision by the German emperor, 1872).
Joint commissions between Canada and the US have dealt with a number of diverse topics: fisheries, defence, the marking of the boundary and the reconciliation of trade statistics.

 International Joint Commission
International Joint Commission, the oldest of Canadian-American intergovernmental organizations, was established by the BOUNDARY WATERS TREATY of 1909 to deal mainly with the apportionment, conservation and development of water resources (including hydroelectric power) along the international boundary.
The IJC comprises 3 Canadian and 3 American commissioners and maintains offices in Ottawa and Washington.
It has been highly successful, and suggestions have often been made that the IJC model, especially its fact-finding techniques, be applied to other problem areas.

 International Boundary Waters Treaty Act
A duplicate original of all decisions rendered and joint reports made by the Commission shall be transmitted to and filed with the Secretary of State of the United States and the Governor General of the Dominion of Canada, and to them shall be addressed all communications of the Commission.
The International Joint Commission shall meet and organize at Washington promptly after the members thereof are appointed, and when organized the Commission may fix such times and places for its meetings as may be necessary, subject at all times to special call or direction by the two Governments.
The salaries and personal expenses of the Commission and of the secretaries shall be paid by their respective Governments, and all reasonable and necessary joint expenses of the Commission, incurred by it, shall be paid in equal moieties by the High Contracting Parties.

 International waters - Wikipedia, the free encyclopedia
The terms international waters or transboundary waters apply where any of the following types of bodies of water (or their drainage basins) transcend international boundaries: oceans, large marine ecosystems, enclosed or semi-enclosed regional seas and estuaries, rivers, lakes, groundwater systems (aquifers), and wetlands [1].
This is particularly evident today with the increase in the number of initiatives related to aquifers, lakes, rivers, coasts and ocean management regimes, as well as of international waters institutions committed to bilateral and/or multilateral management of transboundary water resources.
International waters are one of several focal areas for protection and restoration projects supported by the Global Environment Facility as well as bilateral and multilateral development agencies.

 The International Joint Commission: Canada and the United States of America
Industrial development in both countries, which in the humid eastern border region relied on water resources primarily for waste disposal, had led to decreasing water quality along their shared border to the point where, by the early years of the twentieth century, it was in the interest of both countries to seriously address the matter.
The Commission also has investigative authority -- it may have development projects submitted for approval, or be asked to investigate an issue by one or another of the governments.
The International Joint Commission has met some criticism over the years; most recently some have questioned whether the limited authority of the Commission -- politically necessary when the Commission was established -- is really conducive to the "eco-system" approach called for in the 1987 Protocol, or whether greater supra-legal powers are necessary.

The Commission's recommendations led to the 1938 Rainy Lake Convention that provided for emergency regulation of the level of Rainy Lake and other boundary waters in the watershed.
The Treaty established the International Joint Commission (IJC), a binational judicial tribunal to resolve and to prevent disputes regarding water quality and quantity along the border.

Critiques included: the IJC Priorities for 2001-2003, the United States and Canadian governmental responses to the 10th biennial report of the IJC, the draft 5-year plans for Great Lakes restoration in the U.S. (the “Great Lakes Strategy”) and Canada (the Canada-Ontario Agreement), and the Canadian-U.S. State Of the Lake Ecosystem Conferences 2001 report.
A similar message ran through most of the critiques presented:  none of the documents, priorities and plans are truly strategic and action oriented in terms of the challenges ahead for the region.
