Ex Post: What Is an International Rule of Law? Competing Perspectives on Its Meaning, Feasibility and Desirability
International law is not all human rights and military conflict; it is composed in the greatest part of a well developed, highly ratified system of order for business transactions: ships given passage, piracy suppressed, criminals extradited, tariffs and duties adjusted and negotiated.
International law does not pull states to compliance contrary to their interests, and the possibilities of what international law can achieve are limited by state interests and the distribution of state powers.
In most conceptions of the rule of law, the citizen is entitled to insist that the law be clear, and if it is uncertain, he is entitled to the benefity of that uncertainty; a presumption of freedom.

International committees of bureaucrats, none of whom is elected, craft the management policy for the millions of acres covered by these reserves.
To comply with "international obligations," the United States conforms its management policy, and in some cases, its law, to accommodate the wishes of bureaucrats that are completely unknown to the people who are governed by the policies.

International Law, which is in most other countries referred to as Public International Law, concerns itself only with questions of rights between several nations or nations and the citizens or subjects of other nations.
In this case a general principle may be invoked as a rule of international law because it is a general principle common to the major legal systems of the world and not inappropriate for international claims.
International law is a part of the law of the United States only for the application of its principles on questions of international rights and duties.

international legal argumentation, has suggested that the ideal of an international rule of law is based on contradictory premises and is therefore incapable of providing a useful approach to structuring international society.
The key argument regarding the lack of objectivity of international law and the lack of distance from politics which Koskenniemi considers necessary for the rule of law is based on the contradiction between the requirements of `concreteness' and `normativity'.
It seems convincing that the rule of law implies objectivity in the sense that it is perceived as the opposite of arbitrary power and of the subjectivity of arbitrary rule.

Global gag rule threatens international family planning
The Smith global gag rule aims to defund multilateral and foreign nongovernmental organizations that, with their own non-U.S. funds, provide abortion services beyond cases involving life endangerment of the woman, "forcible" rape, or incest; lobby their government on issues concerning abortion; or violate the abortion law of any foreign country.
The global gag rule is the ultimate in cultural imperialism.
The Smith amendment purportedly is designed to prevent the exportation of the Clinton administration's so-called "international abortion crusade." To the contrary, current law respects the sovereignty of foreign governments, including their abortion policy, by leaving it to those governments to protect or prohibit services and information about abortion.

 The Politics of International Law
The fight for an international Rule of Law is a fight against politics, understood as a matter of furthering subjective desires and leading into an international anarchy.
The vision of a Rule of Law between states (which re-emerged most recently in United Nations General Assembly Resolution 44/23 [15 November 1989] declaring the period 1990-1999 as the "United Nations Decade of International Law") is yet another reformulation of the liberal impulse to escape politics.
Throughout the present century, reconstructive doctrines have claimed that what merits criticism is the corruption of the Rule of Law either in the narrow chauvinism of diplomats or the speculative utopias of an academic elite.

"International Recognition of a Unilaterally Declared Palestinian State: Legal and Policy Dilemmas" by Tal Becker
In accordance with international law, states would be under a legal duty not to recognize the validity of such illegal actions and to withhold recognition from the Palestinian entity.
This is because international law regards the legal requirements for statehood as necessary prerequisites for recognition, but does not view their fulfillment as giving rise to a duty to recognize.
Third, by granting recognition to the Palestinian entity, the international community would indicate that it is willing to recognize as a sovereign state an entity which clearly lacks the traditional criteria for statehood, which was established as the result of an unlawful act, and which has rejected negotiation as a means of conflict resolution.

I would like to highlight some aspects which are within the field of my research interests, namely the theory of international law and in particular the relationship between power and law in international relations, and I shall illustrate the problems by reference to the international conflict over Iraq.
The basic problem faced by the "international community" in Iraq lies in the United Nations Organization having been side-lined, even "subjugated" for the purposes of a unilateral agenda that is in no way compatible with the organization's multilateral mission.
But there is another, unexpected victim of that policy of divide and rule, and that is Europe: As far as the war against Iraq is concerned, we Europeans—and that relates to the member states of the European Union—were not able to speak with a unified voice.

Global Gag Rule Threatens International Family Planning Programs   (Site not responding. Last check: )
Under the terms of the deal, the essence of the Mexico City gag rule was written into federal law as a one-year "rider" to the FY 2000 foreign aid appropriations bill.
The rider provides that overseas NGOs are to be eligible for U.S. family planning funds only if they refrain from using their own funds to provide legal abortion services and to engage in "activities or efforts to alter the laws or governmental policies of any foreign country" concerning abortion.
Considering that USAID is under a mandate to minimize harm to the program, and that the new rules likely will not be operationalized until spring, the political case against the restrictions will have to be based more on principle than on their actual effect.
