Interstate water disputes potentially implicate two federal interests: on navigable waterways, the federal power to regulate navigation is affected; on non-navigable waters, the exclusive power of the federal government to regulate interstate commerce comes into play.
If states thoroughly evaluate their legal and equitable claims to interstate water, and avoid the pitfalls that have plagued previous compacts, the interstate compact may prove to be the best available mechanism to resolve interstate water quantity disputes.
