 Bianco v. California Highway Patrol
Motorcycle helmet owner sought a writ of mandate challenging authority of California Highway Patrol (CHP) to determine which motorcycle helmets were approved and unapproved under state's mandatory helmet law, and specifically that a bulletin issued by CHP that stated a "beanie" helmet he owned failed to meet minimum standards as required by state law.
The Court of Appeal, Todd, J., held that: (1) although federal law preempted California from establishing its own motor vehicle equipment safety standards, it did not preempt California's enforcement of those standards, and (2) evidence supported finding that presumption that helmet met federal safety standards was rebutted by manufacturer's recall of helmet.
Based on this competent objective evidence the California Highway Patrol was and is entitled to cite motorcycle drivers and passengers who wear the E and R fiberglass beanie on the highways for violation of CVC s 27803 which prohibits the use of helmets not meeting FMVSS 218.
