Interstate water disputes potentially implicate two federal interests: on navigable waterways, the federal power to regulate navigation is affected; on non-navigable waters, the exclusive power of the federal government to regulate interstate commerce comes into play.
If states thoroughly evaluate their legal and equitable claims to interstate water, and avoid the pitfalls that have plagued previous compacts, the interstate compact may prove to be the best available mechanism to resolve interstate water quantity disputes.

As early as 1958, the Massachusetts Department of Public Works (MassDPW) began preliminary planning and engineering studies on a proposed controlled-access bypass of MA 12 from I-290 (then designated MA 122A) in downtown Worcester north to MA 2 in downtown Leominster.
Beginning in 1970, officials from Massachusetts and New Hampshire submitted plans to the FHWA for a 63.6-mile-long Interstate highway connecting I-290 in Worcester with I-293 in Manchester.
When the FHWA and the MassDPW released their final environmental impact statement for I-190 in 1973, plans for its eventual extension north to I-93 in Manchester were said to be in a "conceptual stage," but no route had been approved.
