 Maine v. Taylor
Maine, pursuant to 28 U.S.C. § 2403(b), intervened to defend the validity of its statute, arguing that the ban legitimately protects the State's fisheries from parasites and nonnative species that might be included in shipments of live baitfish.
Maine's stake in the outcome of this litigation is substantial: if the judgment of the Court of Appeals is left undisturbed, the State will be bound by the conclusive adjudication that its import ban is unconstitutional.
Not all intentional barriers to interstate trade are protectionist, however, and the Commerce Clause "is not a guaranty of the right to import into a state whatever one may please, absent a prohibition by Congress, regardless of the effects of the importation upon the local community." Robertson v.

Gun Control: State Versus Federal Regulation of Firearms - Maine Policy Review - Margaret Chase Smith Center for Public ...
In Maine, the issue may not be as hotly debated as in other parts of the country, but it periodically polarizes the more rural gun owners who wish to preserve gun ownership and the tradition of recreational hunting from the more urban and suburban families who fear that gun violence may spread to their neighborhoods.
Despite the perception that Maine is a relatively safe place, Maine loses approximately the same percentage of citizens to gun violence each year as the nation as a whole.
Since 1979, Maine has had a system whereby potential victims of domestic violence are allowed to seek a court order (known as a Protection from Abuse Order or PFA Order) requiring the abuser to have limited or no contact with the potential victim.

Dempsey attempted to convince the justices that a Maine statute facially discriminates against interstate commerce by denying property tax exemptions to charities that serve more out-of-state than in-state residents.
Dempsey responded that "nonprofits are in competition and are affecting interstate commerce." Nonprofits are "big business," except that they do not make a profit, he said, adding that the Commerce Clause analysis should be the same whether dealing with nonprofit or for-profit entities.
The case is rooted in the basic premise that the state law facially discriminates against interstate commerce, he continued.
