Be Careful What You Ask For: Attacking the Constitutionality of the Clean Air Act
Missouri's argument that the highway sanctions are not "rationally related to the purpose of highway spending" was a purely facial challenge, according to the court, and, as such, was ripe for the same reasons that the Tenth Amendment claims were ripe.
However, Missouri's argument that the highway sanctions were so burdensome that they violated the Spending Clause was characterized by the court as an unripe, as-applied claim since it was unclear how individual projects would be affected by the funding restrictions.
The court quickly disposed of Missouri's challenge to the offset sanctions by pointing to the fact that, under the Commerce Clause, Congress may impose restrictions on air pollution sources directly or prevent a state from issuing a permit to a pollution source when the permit does not comply with the CAA.

Moreover, Emerson contends that Illinois law should control over Missouri law on public policy grounds, in that the application of Illinois law would compel the defendant carriers to act in accordance with their coverage representations made when the pollution exclusion was first incorporated into the standard CGL policies.
Because Missouri law requires that the terms of an insurance contract be given their plain meaning, the word "sudden" means "abrupt." If it meant "unexpected," it would simply repeat the meaning of "accidental," which includes the unexpected.
Accordingly, in the absence of clear guidance on this issue from either Missouri state courts or federal courts construing Missouri law, we presume, as per the aforementioned rule, that Missouri's law on this question is the same as the law of the forum, Illinois.
