No. 03-1234: Mid-Con Freight v. Mich. Pub. Serv. Co. - Amicus (Merits)
A motor vehicle operating in interstate commerce is always required to have a license plate from some State, and the fees charged for that registration and plating of commercial trucks can run into the hundreds or even thousands of dollars.
The statute in its current form thus preempts state laws that require interstate carriers to register with the State on account of their interstate operations, except in accordance with the standards governing the SSRS, whether or not the relevant state law specifically requires registration of the carrier's federal operating authority.
The statutory and regulatory provisions governing state registration of interstate carriers' federal operating permits speak directly to that question, and those provisions have always imposed strict limits on the amount of fees that may be charged for such registration.

No. 03-1230: American Trucking Ass'n v. Michigan Public Service Comm'n - Amicus Invitation (Petition)
The Court of Claims determined that the $100 interstate fee is not preempted by federal law because the SSRS "places a $10.00 annual vehicle fee limit on only the 'participating states,' * * * not on the 'registering state,'" and Michigan's $100 interstate fee applies only to vehicles registered in Michigan.
Nonetheless, the court held that the interstate fee is not preempted under the SSRS (or the predecessor bingo card system) because it "could reasonably be classified as a regulatory fee," as opposed to a "registration fee." Id. at 16; accord id. at 19.
Interstate carriers that transport even one load between two points in Michigan, as part of their overall interstate operations, are assessed the full $100 intrastate fee.
