Investment protection - Wikipedia, the free encyclopedia
Investment protection is a broad economic term referring to any form of guarantee or ensurance that investments made will not be lost, this may be through fraud or otherwise.
For example, the Investment Protection Bureau is a New York State legal body which is charged, according to the New York State Securities Law (the Martin Act), to protect the public from fraud by monitoring and limiting investment.
Most other protection is of this form, monitoring brokers and comparable individuals, and legally preventing them from misusing investment.

FOREIGN INVESTMENT AND ITS PROTECTION   (Site not responding. Last check: 2007-10-03)
Foreign investment in the local equity market is open to approved Country Funds and Regional Funds, (approval is given by the Ministry of Finance, which is a formality) and Citizens of Foreign States (whether resident in Sri Lanka or outside Sri Lanka) and Sri Lankans resident outside Sri Lanka.
Foreign investment is guaranteed protection by the Constitution of the Republic of Sri Lanka.
Foreign investment entry to operate under the normal laws is conferred under section 16 of the BOI Law which entities the enterprise to repatriate profits and dividends attributable to foreign shareholders.

BALANCING HUMAN RIGHTS AND INVESTOR PROTECTION: A NEW APPROACH FOR A DIFFERENT LEGAL ORDER
Mixed arbitration for the protection of foreign investors has actually existed for centuries, but until the 1960s it was normally pursued on an ad hoc basis through subrogation of a private actor’s claim by its “home” state (i.e., the state of citizenship or incorporation).
International investment protection treaties permit investors to bring claims on their own behalf, or on behalf of their investment enterprises, in the territory of another state party.
In fact, it could be argued that, under most investment protection treaties, host states already possess the ability to bring a counterclaim against the investor for a breach of international law in relation to the activities of the investment in its territory.

Foreign Investment Protection Policies and Anti-Expropriation Measures
Consistent with the heavy emphasis on public sector investment in the post-independence era, the private sector was assigned a relatively minor role, and as a by-product of this policy stance foreign private investment was viewed as desirable only in collaboration with the public sector and with minority equity participation.
It is for this reason that (i) investment data, particularly data related to foreign investment, are not available on an up-to-date basis and (ii) the materialisation of investment as against registration with BOI is not recorded on a continuous basis and the BOI has to embark on periodic surveys to generate the required data.
In the event of losses of foreign investment owing to civil commotion, insurrection or riot, foreign private investment shall be accorded the same treatment with regard to indemnification, compensation, restitution or other settlement as is accorded to investment by the citizens of Bangladesh.

Foreign Investment Protection Policies and Anti-Expropriation Measures
Foreign investment should be perceived and pursued not as a substitute of, but as complementary to, domestic investment and measures should be geared accordingly.
Foreign direct investment should not be regarded from the viewpoint of incentives alone; it has to do with the host country’s total vision as to how to attract and sustain the stream of capital inflows and to what extent it is consistent with the nation’s aspirations and commitment.
Foreign investment can feel secure and protected only when all the conditions for its sustainability in the host country are ensured and that calls for networking of all laws with the enforcement machinery working in an atmosphere of harmony amongst political leaders and public and private stakeholders.

 GRAIN | Briefings | 2004 | Bilateral investment agreement
Though not all investment agreements ensure market access (to the extent that pre-establishment rights are not recognised),[4] they provide broad post-establishment rights, including in some cases the possibility of directly bringing complaints against host States and obtaining compensation.
Investment agreements generally apply to all types of "assets", regardless of their tangible or intangible nature and the sector where they are invested, including various forms of intellectual property.
It may be protected under unfair competition law (which condemns dishonest commercial practices) or, in common law countries, under the doctrine of "passing-off" (the wrong of misrepresenting one's business goods or services as another's, to the latter's injury, generally by using a confusingly trademark or trade name).

An International Framework for the Protection of Investment
But whatever the reason for this change in the evaluation of capitalism, it is hard to deny the growing recognition, among both industrialized and emerging countries, of the importance of protecting the private property rights of investors and of reducing political risk so as to make foreign direct investment more feasible and attractive to investors.
In a sense, the MAI signals the re-emergence of a framework for the protection of foreign investment, which had existed in one form or another until it was watered down in the socialist turmoil of this century.
Additionally, since states are reluctant to breach treaties, tying investment protection standards to a treaty should cause developing states to be even more reluctant to expropriate foreign investment in breach of the MAI’s standards.

FIPAs seek to ensure that foreign investors will not be treated worse than similarly situated domestic investors or other foreign investors; they will not have their investments expropriated without prompt and adequate compensation; and, in any case, they will not be subject to treatment lower than the minimum standard established in customary international law.
Canada began negotiating FIPAs in 1989 to secure investment liberalisation and protection commitments on the basis of a model agreement developed under the auspices of the OECD (Organization for Economic Cooperation and Development).
The principal objectives of this exercise were: to enhance clarity in the substantive obligations; to maximize openness and transparency in the dispute settlement process; and to discipline and improve efficiency in the dispute settlement procedures.

Opposition goes beyond discrimination that limits investment incentives to domestic firms, to encompass investment incentives of any kind which inevitably favor recipients over non-recipients (whether domestic or foreign), promote investment in the jurisdiction providing the incentive, and, in many cases, seek to build the capacity of state-based businesses to expand exports and compete globally.
