The Irish Free State (Irish language:, Saorstát Éireann) was (1922-1937) the name of the state comprising the 26 of Ireland's 32 counties which were separated from the United Kingdom under the Irish Free State Agreement (or Anglo-Irish Treaty) signed by British and Irish Republic representatives in London on December 6, 1921.
The Treaty provided for an all-Ireland thirty-two county state, subject to the proviso that the six Northern Ireland counties, which had their own government under the Government of Ireland Act 1920, could formally opt out of the Free State, which they duly did.
A tiny minority of Irish people, usually attached to small parties like Sinn Féin and Republican Sinn Féin, denied the right of the twenty-six county state to use the name 'republic', continually referring to the twenty-six county state as the 'Free State', its citizens 'Free Staters' and its government the "Free State" or "Dublin" Government.

Each University in the Irish Free State (Saorstát Eireann), which was in existence at the date of the coming into operation of this Constitution, shall be entitled to elect three representatives to Dáil Eireann upon a franchise and in a manner to be prescribed by law.
The Executive Authority of the Irish Free State (Saorstát Eireann) is hereby declared to be vested in the King, and shall be exercisable, in accordance with the law, practice and constitutional usage governing the exercise of the Executive Authority in the case of the Dominion of Canada, by the Representative of the Crown.
All revenues of the Irish Free State (Saorstát Eireann) from whatever source arising, shall, subject to such exception as may be provided by law, form one fund, and shall be appropriated for the purposes of the Irish Free State (Saorstát Eireann) in the manner and subject to the charges and liabilities imposed by law.

The Irish Oath of Allegiance was a controversial provision in the Anglo-Irish Treaty of 1921, which Irish TDs (members of the Irish parliament) and Senators were required to take, in order to take their seats in Dáil Éireann (The Chamber of Deputies) and Seanad Éireann (the Irish Senate).
The Oath had to be taken in front of the Governor-General of the Irish Free State or some other person authorised by him.
In power from 1932, de Valera amended the Free State's constitution firstly to allow him to introduce any constitutional amendments irrespective of whether they clashed with the Anglo-Irish Treaty, then amended the constitution to remove Article 17 of the constitution which required the taking of the Oath.

He served as a member of the committee under Michael Collins, the chairman of the Provisional Government, that drafted the Irish Free State Constitution.
He was subsequently appointed as Irish High Commissioner (ambassador) to the Court of St. James's (the United Kingdom.) When the first governor-general, Timothy Michael Healy retired in December 1927, James McNeill was proposed as his replacement by the Irish government of W.T. Cosgrave and duly appointed by King George V as King of Ireland.
In office, McNeill clashed with the King's Private Secretary when he insisted on following the constitutional advice of his Irish ministers, rather than the Palace, in procedures relating to the receipt of Letters of Credence accediting ambassadors to the King in Ireland.

Under the 1922 Constitution drafted by Michael Collins, the Governor-General of the Irish Free State was the Representative of the Crown in the Irish Free State.
The office was abolished by two enactments, the Constitution (Amendment No.27) Act, 1936 and the Executive Powers (Consequential Provisions) Act, 1937 passed by Oireachtas Éireann in 1936 and 1937 respectively.
