The Honor Council is composed of second- and third-year students who investigate and adjudicate alleged violations of the Honor Code of the School of Law.

While the case was pending in the court of appeals, the president of the university wrote a letter stating that the society would no longer be permitted to use university property, regardless of the outcome of the suit.
In the court of appeals, the society argued that the case was not moot, and the court agreed.
The society made the same argument in the Supreme Court, and the federal government responded by requesting not that the Court find the case moot, but that it remand the case for an evidentiary hearing.
