Apana yesterday told a County Council committee investigating the county's role in approving the projects that he wants the county to purchase the Montana Beach LLC residential development next to Baldwin Beach Park in Pa'ia and the planned Harbor Village shopping center in Lahaina.
Apana said he would like to negotiate the sale of the land, but as a last resort would consider condemnation.
Apana said the Harbor Village site is historically and culturally significant and should be part of Moku'ula, a project that seeks to restore the Mokuhinia Pond and the island residence of King Kamehameha III.

Although the mayor won't submit a formal package of proposed charter revisions until next month, Apana has said he also will seek an amendment that would set aside 1 percent of property tax revenues for a land acquisition fund to buy beach properties and other land for public use.
Commission Chairwoman Terryl Vencl said once the public meetings are done, the panel will hear from Apana's department heads and from experts about how some of the issues brought up for consideration are being handled in other communities.

The council also reduced to $250,000 the $1 million Apana wanted for a solar heater program that would provide money to Maui Electric Co. Ltd., which then would use the money to loan to customers wanting to purchase solar heaters.

A contested case hearing held last week to sort out the Lime Kiln/Montana Beach house/condo mess sparked a new controversy when serious charges of extortion were laid at the feet of former mayor James Apana by two of the attorneys involved.
According to attorney Deborah Wright, during a June 2001 meeting Apana threatened to pull all building permits if all four owners didn’t agree to a 15-foot public access path that Apana wanted as part of a restoration of the ancient King’s Highway that once encircled Maui.
Wright, who represents one of the owners in the dispute, claims that Apana said “I will pull the permits if the deal doesn’t go through.” Her testimony is being used by attorney James Fosbinder to make the charge of extortion against Apana.

Seems that for a three-year time frame Maui Trucking, Inc. President Edward Apana and Secretary/Treasurer Roger Apana weren’t paying out state withholding taxes to their employees like they should have.
Pleading guilty, the Apana boys promised to pay more than $59,000 in restitution.
