Fagan's artillery had not been able to reach the battlefield because of felled trees blocking the road.
Fagan had no artillery available to silence the Federal guns and had no choice but to order his troops to try and take the hill while under artillery fire.
Fagan's men reached the summit of the hill and managed to seize the outer fortifications but were pinned down just short of the summit by the two Union batteries.

Colonel James Fleming Fagan was appointed to command the new regiment, with James Cade Monroe as lieutenant-colonel and James M. O’Neill as major.
Fagan was promoted to brigadier-general a month later, and Monroe succeeded him as colonel commanding the regiment.

Fagan raised the 1st Arkansas Infantry in may of 1861, he and 900 men were mustered into Confederate service in Lynchburg, Virginia.
His attack at Mark's Mill was the deciding factor in General Steele's decision to end his part of the Red River Campaign and retreat to Little Rock.
In September 1864 General Fagan participated in Price's final invasion of Missouri, taking the center route of the three-pronged invasion and successfully captured Fort Davidson at Pilot Knob, Missouri and continue the invasion until routed by Samuel Curtis's Army of the Border on the Little Blue and at Westport.

He is reported to have singlehandedly retrieved a criminal from a local saloon and physically brought him to his court.
He was a strong supporter and personal friend of President James K. Polk.
During the American Civil War a Confederate unit named after Yell was formed in Helena, Arkansas and known as the "Yell Rifles." Yell's nephew James Yell became a Major General of the Arkansas state militia during the Civil War.

In February of 1863 he was placed in command of northwestern Arkansas and successfully recruited and outfitted one of the largest cavalry brigades west of the Mississippi.
Cabell led this brigade in over 20 engagements in the Trans-Mississippi Department including prominent roles at the Battle of Poison Spring and the Battle of Marks' Mill where he commanded two brigades under General James Fleming Fagan.
