Richardson was indicted on Feb.12, 1987, for the capital murder of Gerald Abay, committed during the course of committing and attempting to commit robbery.
Richardson was originally tried for this offense, convicted of capital murder, and sentenced to death on April 21, 1987.

James Richardson was convicted of capital murder for the shooting death of a 35-year-old man during the robbery of the Gusher Liquor Store in Angus, Texas.
James Richardson, 32, was the fourth inmate this month and the 16th this year to be executed in Texas, which leads the nation in capital punishment.
Richardson becomes the 35th condemned inmate to be put to death this year in the USA and the 633rd overall since America resumed executions on Jan. 17, 1977.

Richardson, the subject of a CBS television movie which is currently under development, was successfully defended by nationally acclaimed attorney Mark Lane, in a 1989 hearing on a motion to dismiss his 1968 conviction for the poisoning deaths of his seven children.
Since his release on April 15, 1989, Richardson was totally exonerated by State Attorney Reno who had been appointed by the Governor Bob Martinez as special prosecutor to look into the charges filed by Lane.
Richardson, had open heart, coronary-bypass surgery, after suffering a heart attack while serving his sentence in Daytona's Tomoka Prison in 1986.

James Richardson's case was one of many that was overturned after Fred Zain, formerly of the West Virginia State Police crime laboratory, was investigated for a string of false criminal convictions in which his testimony or credentials were falsified.
Richardson received $2 million from the state Board of Risk and Insurance Management to settle his claims against the State Police and Kanawha County, where he was convicted for the 1989 rape and murder of a Cross Lanes neighbor and then setting her home on fire.
Richardson was released to home confinement in 1996 after his conviction was set aside.
