James "Jim" Thomas Tague (born 1937) was a witness to the assassination of President John F. Kennedy, on November 22, 1963.
Tague had been driving to downtown Dallas to have lunch with a friend when he came up on traffic that was completely stopped on Main Street within Dealey Plaza because of the presidential motorcade.
Tague further testified that he was struck on his face by the second or third shot he remembered hearing, and when pressed by the commission, Tague expressed his belief that he was hit with the second shot.

Posner suggests that the mark on the curb was caused by a lead fragment from a bullet that allegedly struck a limb of the oak tree, in spite of the fact that the tree was at least 400 feet from the curb.
Tague's statement to Liebeler WAS his earliest known comment on the mark, and therefore constitutes his "initial" comment on the subject.

Since photographs of Tague’s wounded cheek and the damaged curb were published immediately after the assassination, the Warren Commission had no choice but to account for the errant shot.

Posner mentioned, in support of his contention that James Tague was hit by a fragment from the first of three shots, that Tague reported in a 1992 interview that he did not know which of the three shots hit him.
I called Tague on April 30, 1994, and he told me the same thing he told the Warren Commission.
Thus, Tague not only flatly contradicts Posner's reconstruction of the shooting, he reveals that Posner misrepresented Tague's views, which have been consistent over three decades.
