It should be noted that, despite Israel 's annexation, East Jerusalem is an integral part of the Occupied Territories, so its Palestinian residents are protected by the Fourth Geneva Convention, which prohibits the occupying power from forcibly transferring civilians from their homes.
In annexing the territory, Israeli flagrantly breached international law, which prohibits "acquisition of territory by force" and change in the legislation in occupied territory.
Therefore, although Israeli law considers Jerusalem part of the State of Israel, under international law, East Jerusalem continues to be occupied territory, whose status is the same as that of other areas in the West Bank.

The barbed wire and concrete barriers which had divided Jerusalem were finally torn down, and Israeli law, jurisdiction and administration was extended to the eastern neighborhoods of the city.
In 1980, the Knesset legislated the 'Basic Law: Jerusalem, Capital of Israel', which restates the position that "Jerusalem, complete and united, is the capital of Israel" and the seat of its main governing bodies.

 Foundation for Middle East Peace :: Israeli Attempt to Impose Absentee Property Law to Arab Property in East Jerusalem
Investigative reporting uncovered that use of the Law was authorized in a secret decision of the Ministerial Committee on Jerusalem Affairs, chaired by Natan Sharansky, held in June 2004, and authorized by the government in July.
Under the original law, Palestinians could become "absentees" without leaving their homes, because, in the period from 1947 to 1967 they were living in the Land of Israel, but not the State of Israel.
It should also be noted that, because of the original use of the Absentee Property Law to transfer millions of acres of Palestinian lands to the new State of Israel, the Israeli authorities, including the Israeli High Court is extremely reluctant to deal with the use of the Law in Jerusalem today.

The Knesset hereby declares that the 28th day of the month Iyar is Jerusalem Day and will be celebrated yearly as a national holiday and will be called "Jerusalem Day".
Jerusalem Day will be an optional day; for the purposes of this paragraph "an optional day" means that the employee has the option to take a holiday or to come to work; if the employee chooses to take a holiday it will be counted as one of his vacation days.
The Prime Minister is authorized to determine which workers, which work and which services are not to discontinue on Jerusalem Day; as well as to determine work hours and work routines to be followed on that day.

Federal law requires State to provide official recognition of Jerusalem, but according to two law suits filed in federal court it is failing to do so.
Under the Act, the United States must provide official recognition of Jerusalem as the capital of Israel, indicating such on passports, birth certificates, and certificates of nationality.
But under Bush, the State Department hasn’t been doing it, claiming instead that the law is only “advisory.” Currently, there are two law suits in federal court seeking to compel the State Department to comply with the law.
