On May 6, 2004, Jessica Cutler, who was a staffer for Ohio Senator Michael DeWine, met Robert Steinbuch, Senator DeWine's counsel on the Senate Judiciary Committee, at a bar at Union Station, near the Capitol.
Cutler lawsuit, however, is the subject of this legal blog, so we should turn our attention to that important, and legally pressing, case.
As Cutler noted in her reply brief requesting dismissal: "[t]he Blog reflected Cutler's attempt to express to her friends how unsavory and power-driven Washington, D.C., can be and how she was navigating the environment." But the case touches on significant privacy issues, and will be of special interest to bloggers.

For those who are unfamiliar with the name Jessica Cutler, here’s the big picture: she blogged about her sexual exploits on Capitol Hill under the name “Washingtonienne.” The racy, snark-filled blog was released as a book after Cutler received a six-figure sum for her work, and she went on to a Playboy gig.
Jessica’s “behavior is not mainstream majority behavior in the same way that most soldiers in Iraq are not abusing people,” Yankelovich says.
Cutler’s outrageous actions, setting before anyone in the world with access to the Internet intimate and private facts regarding Plaintiff, constituted a gross invasion of his privacy, subjecting him to humiliation and anguish beyond that which any reasonable person should be expected to bear in a decent and civilized society.

I'd read The Washingtonienne (Hyperion, 2005), Cutler's barely fictionalized novel chronicling her D.C. exploits—namely partying, fucking congressional workers on their desks, and taking oodles of cash from suitors to pay her rent—but I didn't know Steinbuch's name until his lawsuit, splashed on the Smoking Gun, revealed it.
Cutler quickly cut away that fictional public/private line, dishing what she did sexually and what she thought about it, and that seems to be Steinbuch's biggest problem.
While her actions were selfish to the extreme, Cutler is a symbol of women's precarious place within the world of political power.

Now Wonkette reports that Cutler's third set of attorneys in the litigation Robert Steinbuch has filed against her, and has not yet retained new attorneys.
Because Steinbuch, who waited until May 16, 2005 to complain about a May 4, 2004 blog post, is planning on arguing that every new blog post restarts the statute of limitations for a plaintiff wishing to complain about a blog.
If Cutler defends against this argument pro se, Judge Friedman could be induced into an erroneous ruling that makes life difficult for bloggers everywhere.
